EICR for HMOs: Electrical Safety Requirements for Houses in Multiple Occupation

HMOs carry electrical safety obligations that stack on top of the standard private rental requirements. If you're managing an HMO and treating it like a normal rental for EICR purposes, you're probably under-complying.

The confusion comes from layering. The 2020 Regulations set a national baseline. HMO licence conditions add requirements on top. And from November 2025, there's an industry signal that high-risk housing — including HMOs — may face more frequent inspection cycles going forward.

This article separates the national baseline from what your licence adds, explains the frequency debate (5 years vs 3 years), covers fire alarms and emergency lighting as separate certifications, and breaks down what the Renters' Rights Act 2025 changed on enforcement.

What is an HMO and why does it need special electrical safety rules?

A House in Multiple Occupation (HMO) is defined under sections 254 and 257 of the Housing Act 2004. In practical terms: three or more people, forming more than one household, sharing basic facilities like a kitchen or bathroom.

The definition covers three tests:

  • Standard test — the building is occupied by 3+ people forming 2+ households, sharing facilities, and it's their main residence
  • Self-contained flat test — converted flats where the conversion doesn't meet building regulations and 3+ people forming 2+ households occupy the building
  • Converted building test (s257) — buildings converted into self-contained flats where the conversion predates current building regs and less than two-thirds are self-contained

Mandatory licensing vs additional licensing

Mandatory licensing applies to HMOs with five or more occupants forming two or more households, regardless of the number of storeys. The storey requirement was removed in 2018 (Licensing of Houses in Multiple Occupation (Prescribed Description) (England) Order 2018, SI 2018/221), which brought a lot of previously unlicensed HMOs into the licensing regime.

Additional licensing kicks in below the 5-person threshold. Local authorities can designate areas where any HMO with 3+ occupants must be licensed. If you're in an additional licensing area, the 5-person rule doesn't save you.

Why HMOs are higher risk

Higher occupancy means more demand on the installation. More tenants plugging in appliances, shared facilities getting heavier use, older converted buildings with wiring that wasn't designed for the load. Multiple consumer units serving different parts of the building. Tenant tampering with fire alarms to stop false alarms.

These are the conditions that produce C2s and C1s on EICRs that wouldn't show up on a standard residential inspection. That's why HMOs face tighter rules.

The legal baseline: Electrical Safety Standards in the Private Rented Sector Regulations 2020

The Electrical Safety Standards in the Private Rented Sector (England) Regulations 2020 require all private landlords — including HMO landlords — to have the electrical installation inspected and tested by a qualified person at least every 5 years.

The regulations came into force for new tenancies from 1 July 2020 and for existing tenancies from 1 April 2021.

What the 2020 Regulations require:

  • EICR at least every 5 years
  • Remedial or further investigative work completed within 28 days (or shorter if the report specifies)
  • Copy of the EICR provided to existing tenants within 28 days of inspection
  • Copy provided to new tenants before occupation
  • Copy provided to the local council within 7 days of a request
  • Satisfactory EICR (no C1 or C2 codes) kept on file

If the EICR shows C1 (danger present), C2 (potentially dangerous), or FI (further investigation required), the report is unsatisfactory and remedial work is mandatory. The 2020 Regulations were extended to the social rented sector by a 2025 amendment (SI 2025/1043, effective 1 November 2025). That extension doesn't change private sector HMO requirements, but it signals the direction of travel on electrical safety enforcement.

England, Wales, and Scotland: what differs

The 2020 Regulations apply to England. Wales and Scotland have separate frameworks.

The key point for Welsh landlords: if you're letting a standard residential property in Wales, there's no standalone equivalent of the 2020 Regulations. But if that same property is an HMO, the Housing (Wales) Act 2014 requires an EICR as a licence condition. The HMO status creates the obligation that wouldn't otherwise exist.

In Scotland, EICRs have been required for all private rented properties since 2015 under the Repairing Standard. The 5-year cycle applies to HMOs the same as standard lets. Scottish HMO licensing also typically requires PAT testing of landlord-supplied appliances.

What HMO licence conditions add on top of the 2020 Regulations

This is where most HMO landlords get caught out. The 2020 Regulations are the floor. Your HMO licence conditions are the actual compliance standard you need to meet.

Every HMO licence in England must include a condition requiring an EICR by a registered electrician at intervals of not more than 5 years. But local authorities can — and many do — impose shorter intervals.

Common HMO licence condition requirements beyond the 2020 Regulations baseline:

  • Shorter EICR cycle — many local authorities specify 3 years instead of the 5-year statutory minimum
  • Fire detection to BS 5839-6 — typically Grade D, LD2 minimum (interlinked mains-powered detectors with tamper-proof battery backup in escape routes and high-risk rooms)
  • Emergency lighting to BS 5266-1 — in communal areas and escape routes, particularly in HMOs of 3+ storeys or where escape routes exceed 12 metres
  • PAT testing — for landlord-supplied appliances (not required by the 2020 Regulations, which cover fixed installations only)
  • RCD protection evidence — some licence conditions require evidence of RCD protection on circuits

Always check your specific licence conditions. The licence document is the authoritative source for what your property needs. If you're managing HMOs across different local authority areas, don't assume the conditions are the same — they aren't.

The distinction between "what the 2020 Regulations require" and "what your HMO licence conditions add" is the single biggest source of compliance confusion. Get the licence document out and read it.

EICR frequency for HMOs: 5 years or 3 years?

The 2020 Regulations say "at least every 5 years." That's the statutory floor.

Many HMO licence conditions specify 3 years. Not all — some councils follow the 5-year statutory minimum. But many local authorities treat HMOs as higher-risk properties and use the licence condition mechanism to require shorter cycles.

There's also a third trigger: the inspecting electrician can recommend a shorter interval based on the condition of the installation. If the EICR notes factors that warrant earlier reinspection, the recommended next inspection date on the report may be sooner than 5 years.

What "risk-based inspection frequency" means for HMOs

From November 2025, multiple industry sources have signalled that high-risk housing — including HMOs, older buildings, and converted properties — will require more frequent electrical safety checks than the standard 5-year cycle.

This is an emerging signal, not a confirmed statutory change for private sector HMOs. The GOV.UK guidance (November 2025) extends the 2020 Regulations to the social rented sector but does not explicitly state risk-based frequency changes for private sector HMOs. Industry sources (SRP Inventories, Protestes Ltd) report the risk-based direction, but this may be interpretation of policy direction rather than codified statutory change.

What this means in practice: the statutory 5-year minimum has not changed for private sector HMOs as of July 2026. But if your HMO licence conditions already specify 3 years, you're already operating on a shorter cycle. And if the risk-based approach is formally codified, HMOs are the most likely category to be affected first.

The practical advice is the same regardless: check your licence conditions, follow the inspecting electrician's recommended next inspection date, and don't assume the 5-year statutory floor is what applies to your property.

Beyond the EICR: fire alarms, emergency lighting, and PAT testing

The EICR covers the fixed electrical installation. It doesn't certify fire alarm systems, emergency lighting, or portable appliances. These are separate certifications with separate standards.

Fire alarms — BS 5839-6

Fire detection in HMOs must comply with BS 5839-6:2019. Most HMOs require at minimum a Grade D, LD2 system: interlinked mains-powered detectors with tamper-proof battery backup, installed in all escape routes and high-risk rooms.

The correct grade is set by the fire risk assessment and the local authority licence conditions. Grade D LD2 is the typical minimum, but some HMOs — particularly larger or higher-risk properties — may require Grade A systems with central control, or LD1 coverage (detectors in all rooms, not just escape routes and high-risk areas).

A common finding during HMO EICRs: fire alarm supply circuits with issues. Missing RCD protection on the fire alarm circuit, incorrectly rated protective devices, or signs that tenants have disconnected or tampered with detector heads to stop false alarms. The EICR checks the wiring feeding the alarm system — it doesn't certify the alarm system itself.

Emergency lighting — BS 5266-1

Emergency lighting to BS 5266-1 is commonly required in communal areas and escape routes in HMOs of three or more storeys, or where any escape route exceeds 12 metres. This is widely cited guidance, not a statutory absolute — local authority licence conditions determine the actual requirement for your property.

Emergency lighting requires its own testing and certification, separate from the EICR. Annual testing is standard practice.

PAT testing

PAT testing (portable appliance testing) covers landlord-supplied appliances — not the fixed installation. The 2020 Regulations don't require it. But many HMO licence conditions do.

If you supply white goods, kettles, heaters, or any other appliances in an HMO, check whether your licence conditions require PAT testing. If they do, it's a separate annual or periodic certification, not part of the EICR.

Common HMO EICR failures

These are the findings that show up repeatedly on HMO EICRs:

  • Missing RCD protection on individual letting room circuits (C2) — common in older conversions where circuits were added without RCD protection
  • Overloaded circuits from tenant appliances — bedrooms used as kitchens in bedsit-style HMOs, or multiple high-draw appliances on circuits not designed for the load
  • Missing or incomplete interlinking between fire alarm detectors — especially across floors in converted properties
  • DIY or non-compliant electrical work — older converted properties often have decades of unregulated modifications
  • Multiple consumer units with inconsistent protection — converted properties frequently have separate boards for different parts of the building, with different levels of protection and different ages of installation
  • Tenant tampering with fire alarm heads — disconnected or removed detectors to stop false alarms, which creates immediate safety risk and is a common finding during inspections

HMO EICR cost: what to expect

HMO EICRs typically cost £250 to £500+, compared to £150 to £250 for a standard residential EICR.

HMOs cost more because:

  • More circuits to test
  • Multiple consumer units (common in converted properties)
  • Larger installations overall
  • Fire alarm supply circuits add complexity
  • Older buildings take longer to inspect properly

Cost varies by location, property age, number of storeys, and fire alarm complexity. The figures above are typical ranges, not quotes — get a specific price from a qualified electrician for your property.

Penalties for non-compliance: what happens if your HMO doesn't have a valid EICR

From 1 May 2026, under the Renters' Rights Act 2025 framework, local councils can impose financial penalties of up to £40,000 for breaches of the electrical safety regulations. The previous cap was £30,000.

The Renters' Rights Act 2025 doubles the maximum rent repayment order (RRO) from 12 to 24 months' rent and strengthens penalties for repeat offenders. Operating an unlicensed HMO is one of the most common RRO triggers — if a landlord is caught running an unlicensed HMO, tenants can apply for an RRO covering up to 24 months' rent under the new framework.

A real example: in March 2025, a tribunal ruled against Somerford Assets 3 Ltd in an RRO case involving an unlicensed HMO. The case predates the RRA 2025 changes, but it illustrates the direction of travel — enforcement is getting sharper, and the financial exposure is increasing.

The bottom line: if your HMO doesn't have a valid EICR, you're exposed to a £40,000 fine, an RRO of up to 24 months' rent, and potential licence revocation. And if you're operating without a licence at all, the RRO exposure is the bigger risk.

Managing HMO electrical compliance at scale

Different local authorities impose different EICR cycles — some 3 years, some 5 years. A portfolio spread across two council areas can have staggered renewal dates running on different timelines. Fire alarm annual testing, emergency lighting annual testing, and PAT cycles all run on separate schedules alongside the EICR cycle.
